NYCLA Statement on Senator Palumbo’s Lawsuit Against the New York State Senate

To The Editor of the New York Law Journal:

 

The New York County Lawyers Association (NYCLA) supports a full Senate vote for the Governor’s nominee for Chief Judge, Héctor LaSalle, as Senator Palumbo urged in the litigation he filed in Suffolk County against the New York State Senate. As our prior statements have pointed out and as the complaint in the case alleges, the New York State legislature violated New York constitutional and statutory law when it stacked the deck against the appointment of Héctor LaSalle for Chief Judge of the New York State courts. The New York State constitution makes clear that the confirmation process must be conducted by the entire New York State Senate, not just by a manipulated committee of the Senate. NYCLA will in the future consider any steps necessary to support this and any other litigation that may be filed in support of advancing Justice LaSalle’s nomination in the manner our constitution requires.
