NYCLA Rule of Law Task Force Issues Report on the Constitutionality of Defunding Programs Like SNAP

December 5, 2025, New York, New York — The New York County Lawyers Association’s Rule of Law Task Force today released a report on the constitutionality of defunding food programs, which would strip one in eight Americans of access to food. The report also reviews SNAP litigation and the administration’s handling of the rule of law, finding that:

  • The Administration defied court orders.

  • Claimed authority over constitutional interpretation instead of the courts.

  • Asserted unlimited discretion in applying laws.

  • Ignored the constitutional duty to “take Care that the Laws be faithfully executed.”
