Question. In the opinion of the Committee, is it professionally improper for one member of a law partnership, in the regular employ of the holder of an overdue promissory note, which authorizes an attorney to appear for the maker and confess judgment against him, to represent the plaintiff pro- curing such confessed judgment, while another member of the same firm appears for the defendant and confesses judgment.

 

Answer. In the opinion of the Committee the form of note is such that the confession there under is a right of the holder, and consequently there is no professional impropriety in the course suggested.
