New York City’s new Non-Primary Residence Property Surcharge—commonly known as the pied-à-terre tax—creates substantial annual property-tax liability for certain high-value one- to three-family homes, condominium units, and cooperative apartments that do not qualify as primary residences. This one-hour program will provide a practical guide to the governing statutes and Department of Finance rules, including covered properties, valuation and surcharge calculation, primary-residence standards and exclusions, individual, trust, and entity ownership, claims based on family members and tenants, the DOF notice and verification process, Tax Commission and judicial review, penalties, and current litigation and unresolved implementation issues. The program is intended for real estate, property-tax, cooperative and condominium, trusts-and-estates, litigation, and transactional attorneys who advise property owners, purchasers, sellers, fiduciaries, business entities, or cooperative corporations.
