Indeed, it was the Marshall Court that built the structure for many important areas of law in the United States, as the decisions of the Court dealt with issues focusing on congressional power, property rights, relationships with Native American tribes, and the all-important decision in Marbury v. Madison, which asserted the Court’s power to overturn a law or other government actions that violated the U.S. Constitution.
It was also under the Marshall Court that justices were required to file opinions in writing, rather than orally, as had been the accepted practice, thereby creating a repository of decisions that would long outlive him.
