The recent change to New York Labor Law (198-e) and General Business Law creates joint and several liability for construction managers and general contractors for wage violations committed by subcontractors. 

Damages available under the new law include:  the recovery of unpaid wages (up to 300% of unpaid wages for willful violations); penalties for failing to provide requisite wage notices and statements; and attorneys’ fees.

The changes to section 198-e of the NYLL apply only to the construction industry.

A panel of experts will discuss the details of this law, what can be done to reduce the exposure of these claims and other constitutional and employee law implications of the new law.
