The NYS UCS ADR Office is extending through December 31, 2021, or until further notice, temporary approval of mediation trainings offered online to all 16-Hour Additional Part 146 approved mediation courses.

(1) Pursuant to Part 146, court-based mediation rosters require both a combination of mediation training and experience mediating;
(2) Acceptance on court rosters depends on a court’s need for mediators at any given time and may include a court’s need for mediators with specific case-type training or experience and mediation experience;
(3) Final placement on any court roster is in the discretion of the local Administrative Judge.
This four half-day Divorce Mediation Training course (2 Fridays and 2 Sundays) will cover the basics of New York divorce law, and explore a systematic approach to applying forty specific techniques to overcome the challenges of mediating the complex set of issues presented by divorcing couples. The program is designed for attorneys previously trained as mediators who wish to expand their practice into the field of divorce mediation.
Participants will learn how to help couples reach detailed consensus on issues regarding the parenting of their children, an equitable distribution of the property and liabilities, division of retirement assets, responsibilities for basic and extraordinary child expenses, spousal assistance, health insurance coverage, tax questions, and the strategic timing of a divorce. They will also be introduced to the fine art of drafting a Settlement Agreement, and learn about the bundle of papers needed to obtain an uncontested divorce decree for the parties, as well as ethical considerations.
Learning will take place through lecture, discussion, role play simulations, analysis of videos of actual mediations, and reference to a 400-page training manual that distills the instructor’s thirty-five plus years of experience as a divorce mediator in Manhattan.
