This session will provide an overview of the Restorative Justice landscape and a discussion of the effects of state power on court and community-based
Restorative Justice programs. The potential for Restorative Justice circles in the context of criminal justice is vast but not without challenges.
This program tackles the obstacles to implementation.
Attorneys will consider the Constitutional protected rights of the accused under the 5th Amendment and the implication of them in the models of alternative dispute resolution that exist.
Attendees will gain a general understanding of Restorative Justice as it applies to communities and interactions impacted by the criminal justice system, as well as understand the interplay of the 5th Amendment rights of the accused and ADR
