Mandatory CLE Rules and Regulations

August 17, 2022 Announcement of New Category of CLE credit and NEW REQUIREMENT for ALL New York Attorneys:

The New York State Continuing Legal Education Program Rules (22 NYCRR § 1500) have been amended to add Cybersecurity, Privacy and Data Protection as a new CLE category of credit. Further, both experienced and newly admitted attorneys will be required to complete at least 1 CLE credit hour in Cybersecurity, Privacy and Data Protection as part of their CLE requirement.  Attorneys must comply with the new requirement beginning on July 1, 2023. CLE providers can begin issuing NY CLE credit in Cybersecurity, Privacy and Data Protection to attorneys who take qualifying courses beginning January 1, 2023. So, for example, Experienced Attorneys due to re-register on or after July 1, 2023 (their birthday is on or after July 1, 2023), must complete at least 1 credit in this category as part of their biennial requirement. Newly admitted attorneys who are admitted to the NY Bar on or after July 1, 2023, must complete at least 1 credit in this category as part of their newly admitted CLE requirement.

 

Topics in this new CLE category of credit may include, among other things: cyber threats, cyberattacks, data breaches, the importance of securing and protecting electronic data and communication, appropriate cybersecurity and privacy policies and protocols, and compliance with professional and ethical obligations to protect confidential client and law firm data.

 

While a requirement to complete a CLE credit in Cybersecurity, Privacy and Data Protection has been added to the rules, the TOTAL number of credits experiences attorneys and newly admitted attorneys must complete in each reporting cycle remains the same.

ACCREDITED PROVIDER STATUS
- New York County Lawyers' Association is currently certified as an Accredited Provider of continuing legal education in the State of New York and the State of New Jersey. NYCLA CLE courses also qualify for fulfilling mandatory CLE requirements in the State of Connecticut.

New York State MCLE Requirements

New Jersey State Board on Continuing Legal Education

Attendees at courses qualifying for CLE credit in New Jersey must sign in on the designated sign-in sheets and sign their certificate of attendance at the end of the program. Courses that qualify for New Jersey CLE credit will be so designated on the NYCLA website.

New Connecticut MCLE Requirements

Under Sec. 2-27 A of the Connecticut Practice book, each attorney admitted in Connecticut shall certify, on the registration form required by Section 2-27 (d), that the attorney has completed in the last calendar year no less than twelve credit hours of appropriate continuing legal education, at least two hours of which shall be in ethics/professionalism. Course Credit for Other MCLE States 
Many states with MCLE requirements will grant continuing legal education credits for our courses. If you are admitted to practice in a MCLE state, please contact the appropriate State CLE Administration Office for information.
Effective January 1, 2016, newly admitted attorneys who were admitted after 1/1/2014 may satisfy their Professional Practice and Law Practice Management requirements ONLY by taking classes in any format – live, DVD/CD, On-line, MP3 or webinar. Changes to NY MCLE Requirements for Experienced Attorneys

On January 1, 2018, a new category of CLE credit in New York: “Diversity, Inclusion and Elimination of Bias” will become effective.  The definition includes: courses programs and activities related to the practice of law   and may include implicit or explicit bias, equal access to justice, serving a diverse population, diversity and inclusion initiatives and sensitivity to cultural and other differences when interacting with members of the public, judges, jurors, litigants attorneys and court officials. EFFECTIVE JULY 1, 2018: CHANGE TO EXPERIENCED ATTORNEY BIENNIAL CLE REQUIREMENT TO INCLUDE ONE CREDIT HOUR IN DIVERSITY, INCLUSION AND ELIMINATION OF BIAS

Experienced attorneys (those admitted to the New York Bar for more than 2 years) who are due to re-register on or after July 1, 2018 must complete at least one (1) credit hour in Diversity, Inclusion and Elimination of Bias.  This change does not add to the current experienced attorney biennial CLE requirement of twenty-four (24) credit hours, nor does it change the requirement that experienced attorneys earn at least four (4) credit hours in Ethics and Professionalism.

There are no changes to the CLE requirements for newly admitted attorneys. Newly admitted attorneys may not earn credits in diversity, inclusion and elimination of bias.
