George A. Terezakis, Esq Description: The Supreme Court’s decision in Padilla v. Kentucky, 130 S. Ct. 1473 (2010) has forced the criminal bar to re-think and re-examine tactics and plea agreements for defendants who are either lawful permanent residents or undocumented aliens. As stated in the head notes to Padilla, “when a plea carries a risk of deportation and counsel fails to inform the client of that risk, counsel may be found to have been constitutionally deficient.”
Learn from a panel of experts how to deal with the interdisciplinary problems that may arise when representing non-US citizen clients, as well as how to effectively prevent or overcome them. Topics to be covered include where criminal law and immigration law intersect; the basics of removal proceedings; avoiding deportability and preserving eligibility for relief from removal; discussion of hypotheticals. To receive CLE credit for program on DVD/CD: DVD/CDs are embedded with CLE codes that you must copy onto a supplied affirmation sheet.
