Course Description:

Many lawyers have to deal with clients, experts, witnesses, or other parties who are multilingual. This practical program will explore the issues and challenges of working with interpreters in the courtroom as well as in private practice from the perspective of the interpreter, the judge and the attorney.

Topics to be covered include:

  • Hiring and evaluating the qualifications of an interpreter: "Certified" vs. uncertified interpreters, compensation and scheduling 
  • Preparing to work with an interpreter: client interview, deposition or trial
  • Etiquette and Best Practices: etablishing groundrules, ensuring completeness and accuracy, translating documents
  • Common pitfalls: summarizing, side conversations; misinterpretations
  • Ethical issues: challenges facing multilingual attorneys who try to maintain roles as attorney but have knowledge of language being interpreted and may be tempted to challenge or supplement interpretation being conducted; privilege and confidentiality issues stemming from involvement of family members, friends, law firm staff, and other third parties
